A criminal case was initiated against OUR CLIENT under Part 3 of Article 30 of paragraph "b" of Part 3 of Article 228.1 of the Criminal Code of the Russian Federation, but in the end the court found him guilty only under Part 1 of Article 228 of the Criminal Code of the Russian Federation and imposed punishment in the form of compulsory labor for a period of 200 (two hundred) hours.

Part 3 of Article 30 Part 4 of Article 228.1 of the Criminal Code of the Russian Federation - an attempt to sell drugs in a significant amount is punishable by imprisonment for a term of eight to fifteen years with a fine of up to five hundred thousand rubles or in the amount of wages or other income of a convicted person for a period of up to three years or without it and with restriction of liberty for up to two years or without it.

It can be seen from the case materials that the employees of the UNC of the Ministry of Internal Affairs of Russia in the Kaliningrad region during the operational search event detained OUR CLIENT, during whose personal search, a substance prepared for subsequent sale according to the certificate Nº110/1193 of 13.02.2023, a substance of plant origin is a narcotic Cannabis (marijuana) was discovered and seized. The mass of the narcotic drug Cannabis (marijuana) (in terms of a substance dried to a constant mass at a temperature of 110 °C-115°C) was 13.38 grams included in List 1 of the List of Narcotic Drugs, Psychotropic Substances and their precursors subject to Control of the Russian Federation, approved by the Decree of the Government of the Russian Federation of June 30, 1998 N ° 681 that, according to the Decree of the Government of the Russian Federation No. 1002 "On the approval of significant, large and especially large sizes of narcotic drugs or psychotropic substances, as well as significant, large and especially large sizes for plants, with or their parts containing narcotic drugs or psychotropic substances, for the purposes of Articles 228, 228.1 and 229 and 229.1 of the Criminal Code of the Russian Federation" dated October 01, 2012, is a significant amount, but the criminal intent was not completed due to circumstances beyond the control of OUR CLIENT.

As a result, by the verdict of the Central District Court of Kaliningrad, OUR CLIENT was found guilty of committing a crime under Part 1 of Article 228 of the Criminal Code of the Russian Federation, and he was sentenced to compulsory labor for a period of 200 (two hundred) hours.
